چکیده

حقوق و آزادی‌های شهروندان در کشورهای مختلف، از مباحث مهم مربوط به حقوق اساسی است. اقلیت‌ها یکی از انواع گروه‌های شهروندان هستند که خود به دسته‌ها و انواع گوناگونی همچون اقلیت‌های دینی، مذهبی، زبانی، نژادی و ... تقسیم می‌شوند. با توجه به اینکه موضوع نقض حقوق اقلیت‌های فوق، احتمالی است که نمی‌توان آن را نادیده گرفت، قانون‌گذار اساسی در بسیاری از کشورها، نسبت به تبیین حقوق و آزادی‌های اقلیت‌های دینی و مذهبی اقدام می‌نماید. در جمهوری اسلامی ایران نیز، قانون‌گذار اساسی، در برخی از اصول قانون اساسی علاوه بر اقلیت‌های دینی به طور خاص به بهره‌مندی اقلیت‌های مذهبی از حقوق و آزادی‌های مختلف، تصریح نموده است. بر این اساس، سؤال این مقاله آن است که کیفیت بهره‌مندی اقلیت‌های مذهبی ایران از حقوق و آزادی‌های مختلف، در مقایسه با بهره‌مندی سایر شهروندان ایرانی از این حقوق و آزادی‌ها چگونه است؟ با استفاده از روش تحقیق توصیفی- تحلیلی، این نتیجه به دست آمد که مبتنی بر قانون اساسی جمهوری اسلامی ایران، نظرات شورای نگهبان و قوانین عادی، اقلیت‌های مذهبی در ایران، همانند سایر شهروندان ایرانی و پیروان مذهب رسمی در سطح هنجارهای حقوقی از حقوق و آزادی‌های بنیادین در ابعاد فرهنگی، اجتماعی، سیاسی، اقتصادی، اداری و استخدامی بهره‌مند هستند

چکیده [English]

The rights and freedoms of citizens in different countries are important topics related to fundamental rights. Minorities are one of the types of groups of citizens that are divided into various categories and types such as religious, religious, linguistic, racial, etc. minorities. Considering that the violation of the rights of the above-mentioned minorities is a possibility that cannot be ignored, the constitutional legislator in many countries is taking steps to clarify the rights and freedoms of religious and religious minorities. In the Islamic Republic of Iran, in some of the principles of the constitution, in addition to religious minorities, religious minorities have specifically specified that religious minorities benefit from various rights and freedoms. Based on this, the question of this article is, what is the quality of the enjoyment of various rights and freedoms by Iran's religious minorities, compared to the enjoyment of these rights and freedoms by other Iranian citizens? By using the descriptive-analytical research method, it was concluded that based on the Constitution of the Islamic Republic of Iran, the opinions of the Guardian Council and ordinary laws, religious minorities in Iran, like other Iranian citizens and followers of the official religion, at the level of legal norms of rights and Fundamental freedoms are beneficial in cultural, social, political, economic, administrative and employment dimensions
