همکاری حقوقی دولت‌ها در مقابله با اقدام‌های تروریستی

چکیده
پدیده تروریسم، با توجه به شرایط کنونی جامعه بین‌المللی، ضمن ایجاد توسعه فزاینده در قلمرو حاکمیت، دولت‌ها به عنوان یک جرم سازمان‌یافته، درصدد همکاری و مشارکت فعال با یکدیگر در سطوح منطقه‌ای و بین‌المللی هستند. وجود این پدیده دهشتناک، تحولات حقوقی بسیار گسترده‌ای برای تصویب مقررات کنشی در سطوح ملی و بین‌المللی را فراهم نموده است؛ چرا که دولت‌ها در رویارویی با چنین وضعیتی درصدد تنظیم مقرراتی در سطوح ملی نمودند و با همکاری‌های فراگیر مبادرت به تدوین و وضع اسناد متعددی در این زمینه داشته‌اند. تقویت همبستگی و انسجام در نظام بین‌المللی در قبال اقدام‌های تروریستی و نیز تعهد مقابله با آن در فرایند رعایت قواعد حقوق بشر با تأکید بر تعقیب بازیگران غیردولتی در این عرصه از مهمترین چشم‌اندازهای همکاری‌های میان دولت‌ها به‌شمار می‌آیند. به‌رغم آن‌که دولت‌ها در مواجهه با اقدام‌های تروریستی در سطوح منطقه‌ای و بین‌المللی سازوکارهای حقوقی و اجرایی مؤثری را ارائه نکرده‌اند، اما هیچ یک از سازوکارهای موجود توان رفع چالش‌های ناشی از وجود این پدیده دهشتناک را نداشته‌اند.اتخاذ سازوکارهای اصولی و به‌کارگیری حداکثر تشریک مساعی در میان دولت‌ها با هم و سازمان‌ها در سطوح منطقه‌ای و بین‌المللی در مواجهه با اقدام‌های تروریستی امری انکارناپذیر است. البته تداوم و توسعه چنین سازوکاری در قالب تدوین، تصویب و اجرای صحیح مقررات امکان‌پذیر خواهد بود.

The phenomenon of terrorism, according to the current conditions of the international community, while creating increasing development in the realm of sovereignty, governments, as an organized crime, seek to cooperate and actively participate with each other at the regional and international levels. The existence of this terrible phenomenon has provided extensive legal developments for the approval of action regulations at the national and international levels; Because the governments, facing such a situation, tried to set regulations at the national level, and with comprehensive cooperation, they have taken the initiative to compile and establish several documents in this field. Strengthening solidarity and cohesion in the international system in the face of terrorist acts, as well as the commitment to confront them in the process of observing human rights rules, emphasizing the pursuit of non-state actors in this field, are among the most important perspectives of cooperation between governments. Despite the fact that governments have not provided effective legal and enforcement mechanisms in the face of terrorist acts at the regional and international levels, none of the existing mechanisms have been able to solve the challenges caused by the existence of this terrible phenomenon. It is undeniable that governments and organizations at regional and international levels work together in the face of terrorist acts. Of course, the continuation and development of such a mechanism will be possible in the form of drafting, approving and correct implementation of regulations.
