Virtual collar criminals are a subset of white-collar offenders who commit fraudulent and deceptive crimes by leveraging new technologies in cyberspace. Possessing high cyber intelligence, situational awareness, and anonymity within the dynamic and constantly evolving internet environment, they cunningly conceal their deceptive activities over extended periods. Consequently, the detrimental impact of their conduct is typically far more extensive than that of other criminals, which underscores the critical need for a criminal policy focused on independent norm-setting and preventive criminology. Adopting a descriptive-analytical method, this study reveals that criminal policymaking concerning virtual collar crimes—emphasizing the interaction between norm-setting and the criminal justice response system—entails, on the one hand, differential treatment through independent criminalization, along with a perpetrator-oriented prevention strategy that relies on psychometric testing, mental health assessments, and cognitive-behavioral therapies. On the other hand, it involves a victim-oriented prevention strategy centered on educating and empowering the target community, as well as exploiting intervention opportunities in pre-criminal situations.
