An Analysis of the Conceptual Fluctuation of "Government" within the Framework of Constitutional Principles: "Government" as "State" and "Cabinet/Council of Ministers

Abstract
In the Constitution of the Islamic Republic of Iran, the term "government" has been used to express Four distinct concepts. Each of these concepts places the State in a special legal status, which, in order to identify the rights and duties of the State and the people in the Constitution, should be taken into account in the particular concept of government in each principle. If we do not define the government correctly in principles of the Constitution, it is possible that the principle in question is devoid of content or incompatible with the purposes of the Constitution. Therefore, the concept of government in each principle must be derived from the general principles and evidences used for regulating the said principle .Within the semantics of the word of government in the Constitution, the hypothesis of this research is that the university term of "government" has been used under the meaning of country in 5 principles, including the principles 11, 42, 125, 152 ,155 and in six other principles, including the principles 79, 102, 134, 135, 136 and 138, it means the cabinet.
