Abstract
The enforcement of criminal sentences, as the final stage of the judicial process, plays a fundamental role in realizing criminal justice and safeguarding the rights of convicts. Any deviation from the principles governing this stage may lead to systematic violations of convicts’ rights and undermine the legitimacy of the criminal justice system. The present study, employing a descriptive-analytical method and relying on documentary and library sources, examines the role of adherence to the principles governing the enforcement of criminal sentences in preventing systematic violations of convicts’ rights. In this regard, the principles of prompt execution of sentences, utility of punishment, respect for human dignity, and legality in enforcement have been analyzed as the main focus of the study. The findings indicate that timely and delay-free execution of sentences, while preventing uncertainty for convicts, enhances the deterrent and corrective effects of punishment. Furthermore, attention to the utility and purposeful implementation of punishments prevents the imposition of unnecessary and fruitless suffering on convicts. On the other hand, adherence to the principle of human dignity and strict compliance with the law during enforcement helps prevent arbitrary behavior, institutional abuse, and violations of fundamental rights. Overall, the results suggest that institutionalizing the principles governing the enforcement of criminal sentences, in addition to guaranteeing convicts’ rights, serves as an effective mechanism for preventing organizational deviations and enhancing the efficiency and legitimacy of the criminal justice system.
