The right to education has always been regarded as one of the most fundamental human rights, a status acknowledged by the majority of international human rights instruments, which recognize it as both a fundamental right of individuals and one of the core obligations of States. Education can be interpreted as the right to be human, and the right to flourish and develop—an essential element of human identity. For children, the right to education is the cornerstone of both personal and collective development. However, during armed conflicts, this right is frequently neglected, leaving millions of children worldwide deprived of the opportunity to acquire the skills necessary to contribute to their countries and economies. This generates a bleak and uncertain future for these children and their families. Among the most affected are Palestinian children, who for decades have experienced the reality of war in their daily lives. Thus, a critical examination of the right to education for children in the context of armed conflict, and an analysis of the United Nations Security Council's failure to fulfill its role in protecting this right, is an essential step toward educational justice and the advancement of sustainable global peace. This article adopts a descriptive-analytical approach, focusing on the right to education on one hand, and State obligations to ensure its fulfillment on the other. It ultimately argues that the Islamic foundation of the right to education lies in human dignity, while its legal basis in contemporary international law during armed conflict is rooted in international humanitarian law and relevant Security Council resolutions. However, the Israeli regime has persistently violated both foundations, while the Security Council has maintained a passive stance regarding the rights of Palestinian children.
