چکیده

عملکرد گزارشگران ویژه شورای حقوق بشر و مامورین کمیته حقیقت‌یاب سازمان ملل متحد باعث می‌شود که توجه جامعه جهانی نسبت به وضعیت نقض حقوق بشر در یک کشور جلب گردد و در ثبت و ایجاد سابقه قابل استناد برای نهادها، سازمان‌های بین‌المللی و محاکم بین المللی کمک بسزایی می‌کند. در حالی که رویه های ویژه شورای حقوق بشر به دلیل فعالیت های آنها در رسیدگی به نقض حقوق بشر از طرف سازمان ملل متحد مورد تحسین قرار می گیرد، همزمان توسط کشورهای عضو سازمان ملل به دلیل اقداماتی که ادعا می‌شود با تعهدات آنها سازگار نیست، مورد انتقاد قرار گرفته است. خروج از بیطرفی و استقلال کارشناسان ماموریت از عواملی است که دولت‌ها را نسبت به رویکرد غیرسیاسی شورای حقوق بشر و گزارشگران آن بی‌اعتماد می‌سازد و منجر به عدم همکاری بایسته دولت‌های تحت نظارت خواهد شد. مروری بر تعهدات رویه‌های ویژه از منظر اسناد اصلی حاکم بر فعالیت‌های «کارشناسان مأموریت» سازمان ملل نشان می‌دهد که ضمانت اجرای موثری برای خروج این گزارشگران از بیطرفی و آیینی جهت شکایت از این رویکرد گزارشگران در اسناد شورای حقوق بشر در نظر گرفته نشده است.

The performance of the special rapporteurs of the Human Rights Council and the agents of the United Nations Fact-Finding Committee will draw the attention of the international community to the situation of human rights violations in a country and create a record that can be cited for institutions, international organizations and international courts. While the Special Procedures of the Human Rights Council are praised by the United Nations for their activities in addressing human rights violations, they are simultaneously criticized by the member states of the United Nations for actions that are allegedly inconsistent with their obligations. The departure from the impartiality and independence of the mission experts is one of the factors that make governments distrustful of the non-political approach of the Human Rights Council and its rapporteurs and will lead to the non-cooperation of the monitored governments. A review of the obligations of special procedures from the point of view of the main documents governing the activities of "experts of the mission" of the United Nations shows that the guarantee of effective implementation for the departure of these rapporteurs from impartiality and a ritual to complain about this approach of the rapporteurs is not considered in the documents of the Human Rights Council. .
