The revocation of government regulation under the head of the Islamic Consultative Assembly and the possibility of annulling them in the Administrative Court of Justice

Government resolutions should not contradict the general laws and regulations of the country. The Constitution of the Islamic Republic of Iran has provided for the guarantee of the implementation of this principle within the jurisdiction of the legislative and judicial branches. The "nullification" of government resolutions through the supervision of the Speaker of the Islamic Consultative Assembly and the "annulment" of government resolutions through the general body of the Administrative Court of Justice are two ways to achieve this. This article seeks to examine the relationship between the powers of the two branches of government in supervising government decisions, using a descriptive-analytical method and through library collection, and to explain the procedure of the General Board of the Court of Administrative Justice in considering the acquired rights of the people after the notification of government decisions. From this study and explanation, it was concluded that the entry into force of government decisions after the approval of the Speaker of the Islamic Consultative Assembly within a period of one week, which, according to the Court of Justice, is a type of discretionary supervision, can guarantee the acquired rights of the people, and the supervision of the General Board of the Court of Administrative Justice, after the prior supervision of the Speaker of the Islamic Consultative Assembly, can guarantee other rights of the people against the government. Therefore, it is finally suggested that the aforementioned matters be considered in the process of revising the Constitution of the Islamic Republic of Iran in order to improve relations between the branches of government.
