Identifying the Solutions to Overcome the Challenges of System through the Constitutional Law of the Islamic Republic of Iran

Abstract
A fundamental step of a democratic regime for higher efficiency in realizing desired administration and trust building is to identify dilemmas which cause people’s dissatisfaction. However, the ways to recognize and remove dilemmas in political and legal systems are different in terms of their nature and general laws. Hence, one can say that the number of dilemmas equals with the number of political regimes that are simple or complex due to their similarity or contradiction in administration style and the rate of participation or lack of participation. Present paper attempts to find the roots of current dilemmas in regime through a new approach and to identify the solutions of it by considering existing capabilities and capacities in assigning power to citizens in the framework of Iranian constitution. The main hypothesis is that dilemmas act as the crises against political system and challenge system efficiency. Thus, in Iranian Constitution, there are individual, collective and public guidelines which can act as the solutions of crises and power transition. Present paper employes an analytical – descriptive method to prove the mentioned hypothesis.
